1 Introduction

 

1.1 The following sets out the terms and conditions for the Dead Drop Co Ltd website (trading as Dead Drop Co, with company number 16871733 and registered office address of 44 Shelburne Drive, Haslington, Crewe, England, CW1 5QG). Dead Drop Co may be referred to as ‘we’, ‘us’ or ‘our’ throughout these terms and conditions. 

 

1.2 These terms and conditions apply in whole or in part to all individuals and entities who place an order through our website, or otherwise visit or interest with the website. By visiting and/or interacting with the website, you agree to the applicability of these terms and conditions.

 

1.3 Please note that these terms and conditions are governed by, and construed in accordance with, the law of England and Wales. If you are accessing the website from outside of the UK, you, as a user of the website, are solely responsible for complying with all local laws and regulations. 

 

2 Placing an order 

 

2.1 When you place an order through our website, it is not necessary to create an account. However, you will be required to provide the following information: 

  • Your full name; 
  • Your email address; 
  • Your phone number; 
  • Your postal address; 
  • Your chosen method of delivery; and 
  • Your payment information. 

 

2.2 Once you have placed an order, you will automatically be sent an email acknowledging your order. This does not mean that your order has been accepted. It simply demonstrates that your order has been received. 

 

3 Pre-order 

 

3.1 Due to our business format, some of the items for sale on our website are only available on a pre-order basis.

 

3.2 Once a pre-order window opens, you will be able to place an order for any of the items available in the drop. 

 

3.3 Any pre-orders made within the pre-order window will not be processed until the pre-order window has closed. 

 

4 Order processing and delivery

 

4.1 We aim to process and deliver customer orders as smoothly and as quickly as possible. 

 

4.2 All orders will be shipped to the delivery address provided by you when you check out. 

 

4.3 At present, we only offer delivery to addresses within the UK but this may change over time. 

 

4.4 If your items are not delivered within 30 days of you placing your order, or within 30 days of the pre-order window closing, please send an email to deaddropcoteam@gmail.co.uk so the issue can be investigated. Once the investigation has concluded, we will contact you to organise a refund or the re-shipment of your item(s). 

 

5 Prices and payments 

 

5.1 All relevant prices are displayed on our website. All prices include UK VAT (where applicable) but exclude delivery costs. The cost of delivery will be stated during the ‘check out’ phase of your order. 

 

6 Quality

 

6.1 Items are displayed on our website as accurately as possible. However, due to the nature of the products on offer, there may be some differences between the display of products on our website and the product delivered to you. We try to minimise this risk as much as possible. 

 

6.2 The products offered on our website are naturally subject to wear. The lifespan of a product is only partially dependent on the material of the product and is highly dependent on the intensity of use and the level of care. All items are fitted with a care instructions label. For optimum lifespan and quality, it is important to follow the care instructions. 

 

7 Cancellations 

 

7.1 As our products are sold solely online, i.e. via distance selling, you have the right to cancel any order within 14 days of receiving the product without giving us any reason. However, there are some exceptions to this rule. The right to cancel only applies to goods which are worth over £42, which does exclude a large volume of the products sold on our website. 

 

7.2 To cancel your order you must inform us of your decision to cancel by means of a clear statement by email to deaddropcoteam@gmail.com within 14 days of placing your order. This email should contain your full name and order number. Any cancellation requests made after the 14 day period has expired will be dealt with at our discretion. 

 

7.3 If you cancel your order, and an exception does not apply, we will return all payments received within 14 days of your cancellation notice. Please note that this does not include any delivery charges. Any repayment will be made using the same means of payment that you used in the original transaction, unless otherwise agreed. 

 

7.4 Please note that any repayment can be refused until the goods have been returned to us or until you have provided proof that you have returned the goods. 

 

7.5 Unfortunately, at this time, we cannot cover the costs of return. Therefore, if you choose to exercise your right of cancellation, you will be liable to cover the delivery fees required to return the items to us. 

 

8 Faulty or damaged goods

 

8.1 Irrespective of what products you have ordered or their value, you have the right to return and receive a refund in the following situations: 

  • The product(s) you receive are materially different to the product(s) displayed on our website; or 
  • The product(s) you receive are faulty.

 

8.2 In these situations you will be asked to return the products within 14 days of receiving them so the products can be inspected before any refund is issued. 

 

8.3 Shipping costs for returning products when your products are faulty or damaged will be covered at our discretion. 

 

9 Intellectual property 

 

9.1 With the exception of consent a user adds to our website, all content included on our website, including copyright, trademark material or other intellectual property, belongs to, or is licensed by, Dead Drop Co Ltd. Such content is protected by intellectual property laws and regulations and may not be copied, reproduced or used in any way without express permission from Dead Drop Co Ltd. 

 

10 Limitation of liability 

 

10.1 We, Dead Drop Co Ltd, accept no liability for any damages caused to a user either directly or indirectly through the use of our website, unless required by law. 

 

10.2 Any liability that does arise is limited to the purchase price of the products at issue plus any associated shipping costs paid. 

 

11 Acceptable use policy 

 

11.1 Our website must only be used in compliance with these terms and conditions. 

 

11.2 You must not use this website in a manner that is unlawful or fraudulent. This includes knowingly causing harm to our website by uploading, sending or in any other way transmitting data that contains any form of virus or malware or any other code designed to adversely affect computer, hardware, software or data of any kind, or knowingly cause harm to any other user of our website. 

 

12 Links to other websites 

12.1 Links to other websites may be included on or embedded into our website. The inclusion of such links are for information purposes only or to increase our website's functionality. Inclusion of the links does not imply any endorsement of the websites themselves or those in control of them. 

 

13 Changes to these terms and conditions 

 

13.1 We may alter these terms and conditions at any time. In the case that alterations are made, any such changes will become binding on all visitors upon their first visit to the website after the changes have gone live. 

 

14 Data protection, privacy and cookies 

 

14.1 These terms and conditions have been drafted in accordance with the Data Protection Act 2018. 

 

14.2 Use of the website is governed by our Privacy Policy, which is incorporated into these terms and conditions by reference. 

 

15 Severability 

 

15.1 If any provisions of these terms and conditions are found to be unlawful, invalid or otherwise enforceable by any court or other authority, those specific provisions shall be deemed served from the remainder of these terms and conditions. The remainder of these terms and conditions shall remain valid and enforceable. 

 

16 Law and jurisdiction 

 

16.1 These terms and conditions, and the relationship between Dead Drop Co Ltd and users of the website, whether contractual or otherwise, shall be governed by and construed in accordance with, the law of England and Wales. 

 

16.2 Any disputes concerning these terms and conditions, the relationship between Dead Drop Co Ltd and users, or any matters arising therefore or therewith, shall be subject to the jurisdiction of the courts of England and Wales.
